Cabotage transport: What is the story with loading and unloading locations?
The European Court of Justice has ruled that Denmark is allowed to require that a single cabotage transport in Denmark must include either several loading or several unloading stations.
The cabotage rules are set out in the cabotage regulation (1072/2009). In a recent decision, the ECJ noted that the cabotage regulation's definition of cabotage road transport did not relate directly to how many loading and unloading locations a single cabotage could consist of – although this was probably intended when the rules were written. Because of this ambiguity, the Court found that it is up to Member States to make their own clarifications of this issue, as long as they were in accordance with the principle of proportionality.
